In 1787, our founding fathers came up with a few principles that would establish what we now know as the United States of America. These principles were put on paper to serve as a guideline for how the United States would be operated and structured. This historical piece paper became known as the Constitution of the United States. The mistreatment of slaves frequently included rape and the sexual abuse of women.Many slaves were killed for resisting sexual attacks. The Fugitive Slave Law was passed in 1793 and 1850, intended to assist the progress of the recapture and extradition of runaway slaves during the Civil War. Federal marshals were directed to help recapture slaves. The slave capturer who accused the person that he was the slave would receive five dollars for turning the slave in and 10 dollars if the slave was returned to its owner. Although the North detested against the Law, the southerners had a positive idea about it. There are five classifications of contracts on the basis of validity, nature of consideration, formation, obligation and execution. On the basis of validity, there are five types of contracts namely valid, void, illegal, voidable and unenforceable contracts. Valid Contract Valid contracts are an expressed or written agreement between parties to provide a product or service. Contracts are considered valid when it contains essential elements like offer and acceptance, lawful consideration, intention to create legal relationship, genuine and free consent, competency of parties and agreement not declared void. For instance, car parking tickets having terms and conditions printed on their back makes a person bound to them. Contracts like void contracts, illegal and unenforceable contracts can be disregarded even if it is a signed contract because if other elements of the cont ract are not fulfilled, then signing of such contracts does not make anyone bound by it. Thus, when Stylish discovered that he was misstated by Beauty in respect to inclusion of window coverings, blinds and curtains, he can get out of such contracts even if it is a valid contract. It is on the court to take into account various factors to determine whether the misrepresentation was a material one or was just a mere puff. Contracts are even signed digitally these days where both parties to an agreement can have legal copies of the contract without any hassle of copying, faxing or shipping. In the absence of any misrepresentation or duress, mistakes as to the contract terms cannot enable the signor to get rid of the contract where it is not significantly different from what the signor was agreeing to (Peel Treitel, 2011). Pre-contractual statements Pre-contractual statements are made prior to the formation of a contract. These statements (oral or written) made before entering into a contract is very difficult to be classified because there does not exist any legal proof that can succumb to the validity of these statements. It is well-known that parties (Beauty and Stylish) say various things while negotiating a contract and where sophisticated parties are involved, various pre-contractual statements will be made that will be carefully considered and deemed accurate. These statements are made in order to induce an individual to contract with the representor. For example, Beauty made a pre-contractual statement to Stylish that the value of house included window coverings, blinds and curtains. The word pre clearly suggests that it has been made prior to the validation of contract. However, it must not be assumed that every pre-contractual statement are made with a guilty mind, it can be genuine too. The most important element in a pre-contractual statement is the persuasion that makes people enters into the contract. Categorization of these statements is important as it can impact upon the available remedies. These are classified as mere representation, collateral contract, term of a contract and sales puff (Robertson et. al, 2011). Hence, the pre-contractual statement provided by Beauty to Stylish comes under the category mere representation as it urged Stylish to purchase the house. However, onus is on Beauty to prove that the statement was made with an honest intention and he had reasonable grounds of doing so. But, if the pre-contractual statements are made with a fraudulent motive, counter parties can unwind the contract or even claim for damages or both. In extremes cases, criminal liabilities can be initiated for fraud. After taking into account several considerations, it is the court who will decide whether pre-contractual statements really played a role in the formation of a contract or not. Misrepresentation A contract that is persuaded by misrepresentation can be set aside and result in action for damages. Representations are made before a contract on some relevant matters associated with the contract. These are related to the contract but do not form a part of it, hence it comes under the classification of pre-contractual statements. A misrepresentation occurs when the pre-contractual statements turn out to be false, resulting into loss of the party (Mitchell Mitchell, 2008). The contract between Beauty and Stylish was for Beauty to sell a property to Stylish. The prime point is that because representation does not form part of the contract, if it turns out to be untrue, there is no breach of contract. However, there are certain exceptions to this concept where the aggrieved party can claim for damages or unwind the contract or both. If any pre-contractual statements are made where one party (Beauty) has special knowledge, then it is likely to be assumed that the representation of inc lusion of window coverings and blinds and curtains forms part of the contract. There are seven basic elements that satisfies a legally actionable misrepresentation which are that a statement must be made by conduct or word, statements must be factual, statements must be false, offeree (Stylish) must have relied on the statement, offeree must have been misled, statement must be material to the contract and it must be a factor that induced offeree into the contract. If these elements are satisfied, then it must be seen whether the misrepresentation is an innocent, negligent or fraudulent misrepresentation (Koffman MacDonald, 2007). The onus is on the representor to prove if the statement was made unintentionally on honest grounds or if it was necessary. Negligent misrepresentation implies making false statements honestly but without appropriate grounds. In fraudulent misrepresentation, the intention is clearly to provide damage to the offeree. The intention of Beauty cannot be judged and it depends either on him to prove if he was innocent or on the court to arrive at a proper conclusion. Remedy The basic effect of misrepresentation is that it makes the contract voidable and not void ab initio. Once an actionable misrepresentation is established, it becomes necessary to consider the available remedies available to the offeree or misrepresentee (in this case, Stylish). The first available remedy is rescission which purposes to put the parties back into their original position, as though the contract had not been entered into by anyone. The aggrieved party can present a notice to the representor and thereafter rescind the contract (Gibson Douglas, 2013). Rescission can also be initiated by obtaining an order from the court. If the representee discovers the misrepresentation but still fails to avoid the contract, then he or she cannot rescind the contract. In case of a fraudulent misrepresentation, the time limit runs till the discovery of such misrepresentation by the representee or offeree whereas in an innocent misrepresentation, the right to rescind does not exist (Bernste in, 2008). In the given case, Stylish can obtain an order from the court or inform the representor (Beauty) about such misrepresentation and rescind the contract. The second remedy available is damages where the aggrieved party can claim damages for fraudulent misrepresentation in the tort of deceit. If it is a negligent one, then the aggrieved party can claim only for his or her actual losses. The purpose of such remedy is to restore the representee or aggrieved or offeree to the position he occupied prior to such contract. In the given case, Stylist can claim for damages by Beauty on account of such misrepresentation. However, the intention of such representation, that is whether innocent or negligent must be proved by Beauty. It can be concluded that this case was more likely a fraudulent misrepresentation and Stylish stands a good opportunity in court to sue Beauty. However, Stylish must have done his job perfectly before proceeding with the purchase. Although, very slight, but there can also be a chance that this was an innocent misrepresentation but on a whole, it depends on the court to decide whether Beauty was right or Stylish was wrong. Evolution Of Man The evolution of man is an area of study that will never fully be understood, however, evidence has been accumulated to allow us to paste together a picture of what happened in the beginning of time. It allows us to gather an idea of how man progressed to exist in the state in which we see him now. We can see that the evolution of man was directly influenced by his environment. Mans intellectual development directly effected the physical changes that we see. It is apparent through observation that the environmental changes also induced some of the physical changes that man underwent. These environmental changes and seemingly intellectual development slowly refined mans behavior, as well as his way of life. We also can see how man develops along with the changes in sophistication of the tools he used. We can observe that the progression of the tools coincide directly with the progression of the evolution of man. As the technology, as simple as it was, slowly became more advanced, we see how the apparent effect that it has on early mans development and how those advances made, effected the actions and behavior of man. It is essentially those changes in behavior and lifestyle which lead to mans evolution. In this paper, I will include some of my observations of the physical development of man from ancient human-like animals to modern day man. At the American Museum of Natural History I observed the exhibit of Lucy. Lucy was found in Hadar Ethiopia and is the name given to a fossil skeleton of a hominid who lived over 3.2 million years ago. Lucy stands as the most complete skeleton known of an early human predecessor. She is known to be part of the bipedal primate know as Australopithecus afarensis. Lucy was expected to be twenty-five years old and roughly four feet tall. What we know about Australopithecus afarensis is that they walked upright and were able to climb trees. Australopithecus afarensis, like Lucy, had small skulls, small brain cases, projecting faces, large chewing teeth and looked ape-like. Looking at Lucy, my tour guide pointed out her primitive limb proportions. Although she did walk upright on two legs, her legs were very short, adopted to climbing, indicating that she may have taken shelter in the trees at night. We can also observe that Lucy had very long hands. The proportion of her hands in comparison to her short legs would implicate that she walked in a different fashion than the way we do today. She would have had to swing her arms around, making her motions similar to those of an ape. Five million years after Lucy, Australopithecus africanus appears. This creature also walked upright but lived in relatively open country and obtained food mainly by gathering and scavenging. Australopithecus africanus face did not project as far as his ancestors, had smaller incisor teeth and a slightly larger brain compared to body size. I enjoyed the exhibit of Australopithecus africanus because it showed what he would have looked like with flesh. It looked like a hairy, short cross between man and ape. In the same exhibit as Lucy was Turkana boy. He was found in 1984 at Nariokotome, Kenya. Turkana boy existed about 1.6 million years ago and looks more like modern man. The Turkana boy was five feet three inches and weighed one hundred and six pounds. Although we would view his skeletal height as that being one of an adult, his bones were those of an adolescent. It was believed that if he had lived to maturity, he would have grown to about six feet one inch and would have weighed approximately one hundred and fifty pounds. The proportions of his body maximized the surface area to best shed body heat in a hot dry open environment. He was more advanced than Lucy and had increased brain cell capacity and had rock tools which was evidence of hand crafted tool kits which were primitive but sophisticated. Turkana boy came about one million years after Lucy and it is interesting to see the difference in their skeletal structure. He is tall and his neck is very close to the body, his skeleton reveals a more complex being , whereas Lucy had a little frame and looks more animal-like. Once slowly working through it, and more data was taken from me, information on what jobs I would be interested in matched much more consistently to my ideas. The three jobs I found to most suite what I am interested in are Computer Network Telecommunications Technician, Computer Network Systems Administrator, and Engineer, Computer Systems. A Computer Network Telecommunication Technician (CNTT) includes the assistance to a network administrator dealing with hardware, software, or infrastructure to an information system. As this career does not require a bachelorââ¬â¢s degree, it would be just a start to moving up the chain of command. As the skills needed in this job are Technical, Computer literacy, and diagnosing I believe I am well prepared to do this job. As the work conditions are nearly equal to an eight to five job, not many overtime hours, but this comes with the basic salary of 30 ââ¬â 35 thousand dollars per year. A Computer Network Systems Administrator (CNSA) is the knowledge to know what and when to install in an information system, as well as the capability to install and maintain. This career requires a bachelorââ¬â¢s degree in some type of information systems degree. Skills needed in this occupation would include Information Handling, Computer Literacy, and diagnosing. These three jobs also are included in what I believe I am capable of. As this position is a bit more time consuming, as well as the knowledge needed to take this position is more than the previous, the pay is higher. The salary for this occupation is 35 to 42 thousand a year. An Engineer of Computer Systems also known as a Systems Analyst is the occupation I am aiming for as a lifetime career. In this career, you would be in charge of handling the information data needs of users, inside and outside of your company. This position in todayââ¬â¢s economy is growing rapidly. According to Career Choice, it is neither as high paying, nor as in demand as it really is. I am currently enrolled in a class on this subject of the information systems market. This is a very interesting subject, learning how to design and put in place everything from business processes to new technology. As this job is very much in demand in todayââ¬â¢s economy, it is also not an easy one. Once the skill sets used in this occupation is part of my skill set, which I plan to retrieve from the first two previously described occupations. This occupation according to Career Choice requires knowledge in number computing, technical, computer literacy, and diagnosing. Each of the se skills are definitely needed, yet only real world experience can get you the skills needed to complete this occupation. The CNTT position as well as the CNSA position are very similar, and are very close in the chain of command, they both are jobs I consider to have at some point before I attempt at an Systems Analyst position. I do not believe I can fulfill my duties needed to be a Systems Analyst without the real world experience first. As I have been associated with the Information Systems world for years, I believe the base salaries given by Career Choice are low balled, and are much higher, especially with information systems degree. As the skill sets between the first two are similar, they are both similar to the third occupation. Luckily Career Choice came to the same conclusions of what I wanted to do with my life.
